Quick answer: PT PMA, Hak Pakai and leasehold are not interchangeable. A company structure concerns business eligibility, while property rights and contracts determine what interest is held in land or a building.
Start with intended use

Personal residence and operating tourist accommodation can require different rights, activities, permits and tax treatment. Choose a structure only after identifying the actual property and activity.
PT PMA capital rules
BKPM Regulation 5/2025 changed the general minimum paid-up capital to IDR 2.5 billion, but that is not the same as the investment-plan threshold, which may be higher and depends on the business. Confirm the latest rules and sector-specific exceptions with counsel.
Hak Pakai and other rights
Availability depends on the person or company's eligibility, the underlying land and the specific property. A lease is a contractual interest, not automatically a registered ownership title.
Avoid nominee shortcuts
Putting rights in an acquaintance's name can leave the foreign buyer without the protections they expect. Independent legal advice is essential.
Check the operator
A PT PMA does not automatically have every accommodation licence. Verify KBLI, OSS requirements, zoning and the building's permissions.
